1. Acceptance of Terms

By accessing or using sandiegotech.org and its subdomains (the "Site"), you agree to be bound by these Terms of Use ("Terms") and our Privacy Policy. If you do not agree to these Terms, please do not use the Site.

These Terms apply to all visitors, users, and others who access or use the Site.

2. About SDIT

The San Diego Institute of Technology ("SDIT") is a 501(c)(3) nonprofit organization (EIN: 39-2954006) incorporated in the State of California. SDIT operates as a research and education institute and makes its curriculum and educational materials freely available to the public.

3. Permitted Use

You may access and use the Site for lawful, personal, and educational purposes. You may:

  • Browse, read, and share content from the Site for personal and educational use
  • Access and use the open curriculum under the terms of the applicable Creative Commons license (see Section 5)
  • Contact SDIT through provided channels to inquire about programs, fellowships, or partnerships
  • Link to the Site from other websites, provided such linking does not imply endorsement or affiliation without SDIT's written consent

4. Prohibited Conduct

You agree not to:

  • Use the Site in any way that violates applicable federal, state, local, or international law or regulation
  • Attempt to gain unauthorized access to any portion of the Site, its servers, or any systems connected to the Site
  • Introduce malware, viruses, or any other harmful or disruptive code or material
  • Use automated tools, bots, or scrapers to access the Site in a manner that imposes an unreasonable burden on our infrastructure
  • Impersonate SDIT, any SDIT employee, faculty, fellow, or any other person
  • Misrepresent your affiliation with SDIT or use the SDIT name, logo, or identity in an unauthorized manner
  • Collect or harvest personal information from the Site without authorization
  • Use the Site to send unsolicited communications

5. Open Curriculum License

SDIT's academic curriculum, course materials, reading lists, syllabi, and educational content hosted on GitHub (github.com/sandiegotech/sdit) are made available under the Creative Commons Attribution 4.0 International License (CC BY 4.0).

Under CC BY 4.0, you are free to:

  • Share — copy and redistribute the material in any medium or format
  • Adapt — remix, transform, and build upon the material for any purpose, including commercially

Under the following condition:

  • Attribution — You must give appropriate credit to the San Diego Institute of Technology, provide a link to the license, and indicate if changes were made. You may do so in any reasonable manner, but not in any way that suggests SDIT endorses you or your use.

The CC BY 4.0 license applies to curriculum content on GitHub. It does not apply to the SDIT name, logo, website design, or any other institutional identity materials.

6. Intellectual Property

All content on the Site not covered by the CC BY 4.0 license — including but not limited to the SDIT name, logo, website design, graphic elements, and original institutional content — is the property of the San Diego Institute of Technology and is protected by applicable United States and international intellectual property law.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit SDIT's institutional identity materials without prior written permission. To request permission, contact brandon@sandiegotech.org.

7. Third-Party Links and Resources

The Site contains links to third-party websites, including GitHub, and other external educational resources. These links are provided for convenience and informational purposes only. SDIT does not control and is not responsible for the content, privacy practices, or accuracy of third-party sites. The inclusion of any link does not constitute an endorsement by SDIT.

8. Disclaimer of Warranties

THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SDIT DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

SDIT does not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components. SDIT does not warrant the accuracy, completeness, or usefulness of any information on the Site.

SDIT is not currently accredited. No warranty is made regarding the transferability of credits, recognition of credentials, or eligibility for financial aid. See our Accreditation page for full disclosure.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SDIT OR ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR VOLUNTEERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES — INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SITE OR ITS CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

SDIT's total liability to you for any claim arising from these Terms or your use of the Site shall not exceed fifty dollars ($50.00).

10. Indemnification

You agree to indemnify, defend, and hold harmless SDIT and its officers, directors, employees, agents, and volunteers from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Site, your violation of these Terms, or your violation of any applicable law or the rights of any third party.

11. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Site shall be subject to the exclusive jurisdiction of the state and federal courts located in San Diego County, California.

12. Changes to These Terms

We reserve the right to revise these Terms at any time. We will post any revised Terms on this page with an updated effective date. Your continued use of the Site after the effective date of any revisions constitutes your acceptance of the revised Terms.
